Regulations on Vessel Management in Jingpo Lake Waters

Article 1: These Regulations are formulated to strengthen the management of vessels in Jingpohu Lake waters, maintain transportation order, and protect the ecological environment of the area, in accordance with the "Water Pollution Prevention and Control Law of the People's Republic of China," the "Regulations on the Safety Management of Inland Waterway Transportation of the People's Republic of China," the "Scenic and Historic Areas Regulations," the "Domestic Waterway Transportation Management Regulations," and other relevant laws and regulations, taking into account practical circumstances.

Article 2: These Regulations apply to the management of vessels engaged in transportation, tourism, production operations, sports, entertainment, and other activities within the water area of Jingpohu Lake in the Jingpohu Lake Scenic Area.

The Jingpohu Lake waters referred to in these regulations refer to the area enclosed by the following boundaries: south from the entrance of the Mudan River into Jingpohu Lake to the shoreline of Xihu Xiu; north to the shoreline of the Jingpohu Lake overflow dam, Jingpohu Lake Villa, Baoyue Bay, and Luyuan Island; west from the Erzhan River estuary to the shorelines on both sides of Daoshi Mountain; and east to the natural mountain ranges and lake branches including the aquatic farm, Dajiangyao Gully, Weizigou Forest Farm, and Beihutou Forest Farm.

The term "vessels" in these regulations refers to all types of watercraft, whether displacement or non-displacement, including boats, rafts, waterborne aircraft, submersibles, mobile platforms, and other mobile waterborne devices.

Article 3: The management of vessels in Jingpohu Lake waters shall adhere to the principles of ecological priority, safety assurance, total quantity control, and classified management.

Article 4: The People's Government of Mudanjiang City shall strengthen leadership over the management of vessels in Jingpohu Lake waters, establish and improve a coordination mechanism for vessel management in Jingpohu Lake waters, and study and resolve major issues related to vessel management in the area.

Article 5: The administrative body of Jingpohu Lake Scenic Area, as an agency dispatched by the People's Government of Mudanjiang City, shall enhance the management and coordination of vessels in Jingpohu Lake waters and oversee tasks related to transportation, port, and waterway management within the lake's waters.

The Mudanjiang Maritime Administration Authority exercises supervision and management over water traffic safety in the navigable waters of Jingpohu Lake under its jurisdiction in accordance with the law, as well as oversees the prevention and control of ship pollution in the waters of Jingpohu.

The Mudanjiang Municipal People's Government's departments responsible for ecological environment, transportation, agriculture and rural affairs, sports, public security, and emergency management shall, according to their respective duties, carry out vessel management work related to the Jingpohu Lake waters.

The Ning'an Municipal People's Government and the township people's governments along the Jingpohu Lake shore shall strengthen the management of ferry ports, ferry boats, and township-owned vessels in the Jingpohu Lake waters.

Article 6: The administrative body of Jingpohu Lake Scenic Area, the Mudanjiang Maritime Authority, and relevant departments of the Mudanjiang Municipal People's Government shall establish and improve a notification system for major vessel management matters in the Jingpohu Lake waters, enhancing information sharing, joint supervision, and law enforcement coordination.

Article 7: The administrative body of Jingpohu Lake Scenic Area, the Mudanjiang Maritime Authority, and relevant departments of the Mudanjiang Municipal People's Government shall strengthen the publicity of laws, regulations, and rules related to scenic areas and vessel management, raising the legal awareness of vessel owners, operators, drivers, and the general public.

Article 8: Any unit or individual has the right to report acts that hinder vessel management in the Jingpohu Lake waters, disrupt transportation order, or damage the ecological environment of the Jingpohu Lake waters.

Article 9 The administrative body of the Jingpohu Lake Scenic Area shall entrust relevant institutions to assess the carrying capacity of various types of vessels in the waters of Jingpohu, based on the scenic area's planning, the lake's water environment, and its carrying capacity.

Article 10: Except for existing vessels in the Jingpohu Lake waters, any other vessels entering the Jingpohu Lake waters shall report to the management authority of the Jingpohu Lake Scenic Area.

The management authority of the Jingpohu Lake Scenic Area shall promptly notify relevant agencies and departments about the details of vessels granted permission to enter.

Article 11: Vessels operating in the Jingpohu Lake waters shall be equipped with corresponding pollution prevention, life-saving, communication, fire-fighting, positioning, emergency equipment, and devices in accordance with relevant national and provincial regulations, and maintain them in good technical condition.

Article 12: Discharging ship pollutants such as oily wastewater and domestic sewage into the Jingpohu Lake waters is prohibited.

Ship pollutants in the Jingpohu Lake waters shall be centrally received, transferred, and disposed of.

The administrative agency of the Jingpohu Lake Scenic Area shall, in collaboration with the Mudanjiang Maritime Authority and relevant departments of the Mudanjiang Municipal People's Government, establish and improve a joint supervision mechanism for the transfer and disposal of ship pollutants.

Article 13: For projects such as boat tours on Jingpohu, the management agency of Jingpohu Lake Scenic Area shall determine the operators through fair competition methods like bidding, in accordance with relevant laws, regulations, and the planning of the scenic area.

The management agency of Jingpohu Lake Scenic Area shall sign written contracts with the operators to legally define their respective rights and obligations. Operators shall pay fees for the compensated use of scenic resources in accordance with the law.

Operators of ship tour services shall determine service prices and make them public based on factors such as the facilities of the tour vessels, the tour routes, and the service content.

Article 14: Operating water transport services within the Jingpohu Lake waters requires obtaining relevant permits in accordance with the law.

Water transport operators who have legally obtained permits must use vessels with valid operation certificates for water transport activities.

Article 15: Motorboats, rubber boats, rafts, pedal boats, and other vessels used for sports or recreational activities within the Jingpohu Lake waters must not operate beyond the boundaries designated by the Jingpohu Lake Scenic Area administrative authority.

The management authority of Jingpohu Lake Scenic Area shall delineate the activity zones for relevant vessels based on consultations with Mudanjiang Maritime Administration, relevant departments of Mudanjiang Municipal People's Government, and Ning'an Municipal People's Government.

Article 16: Where entities and individuals must access production, operation, or other areas via waterborne transportation through the waters of Jingpohu, their private vessels shall navigate within the zones designated by the management authority of Jingpohu Lake Scenic Area.

Article 17: The management authority of Jingpohu Lake Scenic Area shall, after consulting with Mudanjiang Maritime Administration, relevant departments of Mudanjiang Municipal People's Government, as well as vessel owners and operators, delineate docks (berthing points) for vessels in Jingpohu Lake waters according to the principles of zonal classification, centralized berthing, and convenience for navigation. These designations shall be publicized before being submitted to Mudanjiang Municipal People's Government for approval and announcement.

Article 18: Vessels in Jingpohu Lake waters shall berth at legally announced docks (berthing points). In case of emergencies requiring berthing at other locations, reports shall be made to Mudanjiang Maritime Administration, the management authority of Jingpohu Lake Scenic Area, or relevant departments of Mudanjiang Municipal People's Government.

Vessels in Jingpohu Lake waters shall comply with the environmental protection requirements of docks (berthing points) as well as safety, public security, and fire control regulations.

Article 19: Vessels entering or leaving docks (berthing points) in the Jingpohu Lake waters shall, in accordance with the law, report relevant information such as voyage plans, seaworthiness status, crew composition, and cargo or passenger loads to the Mudanjiang maritime management authority.

Article 20: The shipowner or operator shall remove the decommissioned vessel from the Jingpohu Lake waters within three months from the date of its decommissioning.

Article 21: Violation of Article 10 of these Regulations by unauthorized entry of a vessel into the Jingpohu Lake waters shall result in the Jingpohu Lake Scenic Area management authority ordering cessation of the illegal act, issuing a warning to the shipowner, operator, or driver, and may additionally impose a fine ranging from 500 to 3,000 yuan.

Article 22: Vessels that fail to equip corresponding facilities and devices, fail to maintain the facilities and devices in good technical condition as stipulated in Articles 11 and 12 of these Regulations, or discharge pollutants into the Jingpohu Lake waters shall be dealt with according to law by the Mudanjiang Maritime Administration and relevant departments of the Mudanjiang Municipal People's Government within their respective duties.

Article 23: Where vessels engaged in sports or recreational activities operate beyond the designated areas in violation of Article 15 of these Regulations, the Jingpohu Lake Scenic Area Management Authority shall order corrections and may impose a fine ranging from 500 to 3,000 RMB on the vessel owner, operator, or driver.

Article 24: Where self-use vessels of relevant units or individuals fail to navigate in designated waters in violation of Article 16 of these Regulations, the Jingpohu Lake Scenic Area Management Authority shall order corrections; if corrections are refused, a fine ranging from 1,000 to 5,000 RMB shall be imposed.

Article 25: Where vessels fail to dock at legally announced wharves (berthing points) or fail to report relevant information when entering or leaving wharves (berthing points) in violation of Articles 18 and 19 of these Regulations, the Mudanjiang Maritime Administration shall handle the matter according to law.

Article 26: Where laws and regulations provide otherwise regarding the management of scenic areas and vessels, such provisions shall prevail.

Article 27 These Regulations shall come into force on March 1, 2024.
