Heilongjiang Province Establishes Strict "Red and Black List" for Tourism Industry Integrity: Coexistence of Red and Black to Punish the "Black"

On the 10th, the Heilongjiang Provincial Tourism Development Committee issued the "Management Measures for the 'Red and Black List' of Integrity Tourism Construction in Heilongjiang Province (Trial)" to strengthen integrity tourism construction, establish a mechanism for rewarding trustworthiness and punishing dishonesty in the tourism industry, and promote the sustained, healthy, and stable development of tourism.


The Measures apply to the credit rewards and penalties for tourism operators such as travel agencies, star-rated hotels, A-level scenic spots, and S-level ski resorts, as well as tourism practitioners including tour guides and tour leaders within the administrative region of Heilongjiang Province.


Tourism operators and practitioners are all included in the "Red and Black Lists." 


The "Red List" for integrity tourism construction refers to tourism operators and practitioners who comply with laws and regulations, adhere to honest and trustworthy operations, implement safety responsibility systems, and have a good exemplary and driving effect, actively promoting the construction of tourism integrity. The "Black List" for integrity tourism construction refers to tourism operators and practitioners who, upon verification, have violated laws and regulations, failed to fulfill legal obligations, breached the principles of integrity and commitment, engaged in fraud, neglected safety responsibilities, or inadequately managed safety, thereby causing negative social impacts.


Tourists who meet any of the following conditions will be included in the "Red List" for integrity in tourism: 


Tourism operators and practitioners who have been rated as excellent in inspections, supervision, or assessments by provincial-level or higher tourism-related departments; those who have won awards in competitions, selections, or creation activities organized by provincial-level or higher tourism-related departments or tourism industry organizations; newly rated or upgraded 4A-level or above tourist attractions, four-star or above hotels, 3S-level or above ski resorts, and top 100 travel agencies; tourism operators and practitioners whose safety work has been publicly commended by provincial-level or higher authorities during inspections or undercover visits.


In any of the following circumstances, individuals shall be included in the "blacklist" for integrity in tourism: 


Tourism operators and practitioners who have received administrative penalties above fines for infringing on the legitimate rights and interests of tourists; tourism operators involved in major safety accidents where they bear primary responsibility; tourism operators and practitioners who have been ordered by court judgments to bear full or primary civil liability for infringing or breaching contracts that harm tourists' legitimate rights and interests, or who refuse to comply with court judgments; legal representatives of tourism enterprises and practitioners who have been sentenced by courts for infringing on tourists' legitimate rights and interests; tourism practitioners who have received administrative penalties or been held liable by court judgments for disrupting public order, damaging public facilities, destroying cultural relics at tourist destinations, or violating local customs during their practice; tourism operators and practitioners whose actions infringe on tourists' legitimate rights and interests, causing serious negative social impacts; other circumstances where tourism operators and practitioners violate laws and regulations.


Where both red and black records exist, the "black" record shall be punished. 


It is understood that when tourism operators and practitioners meet both the "Red List" and "Black List" criteria, they will be placed on the "Black List." Tourism operators and practitioners listed on the "Red List" for integrity tourism construction will be removed from the list if found to have violated laws or regulations during the publicity period. If they meet any of the eight specified conditions, they will be added to the "Black List" for integrity tourism construction.
